Use of Services

lunarcresters provides professional fulfillment centre services including inventory management, order processing, warehousing, and logistics solutions for e-commerce businesses. Our services are provided subject to these Terms and any additional agreements entered into between you and lunarcresters.

Eligibility

You must be at least 18 years old and have the legal authority to enter into agreements to use our services. If you are using our services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

Account Registration

Some services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

Pricing and Payment

Our pricing for services is as quoted in your service agreement or as published on our website. All prices are quoted in Euros (EUR) unless otherwise specified. We reserve the right to change our prices at any time with appropriate notice.

Payment Terms

• Invoices are typically issued monthly and are due within 30 days of the invoice date
• Late payment fees may apply to overdue accounts
• We reserve the right to suspend services for non-payment
• All fees are non-refundable unless otherwise specified in writing

Intellectual Property

The lunarcresters website, services, and all related content, including but not limited to text, graphics, logos, images, and software, are the property of lunarcresters AS and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and services for their intended purpose. This license does not include any right to:

• Reproduce, distribute, or publicly display our content
• Modify or create derivative works based on our services
• Use our trademarks or branding without written permission
• Reverse engineer or attempt to extract source code

User Content

You retain ownership of any content you provide to us, but you grant us a license to use, store, and process such content as necessary to provide our services. You represent that you have the right to provide such content and that it does not violate any third-party rights.

Privacy and Data Protection

Limitation of Liability

To the maximum extent permitted by applicable law, lunarcresters AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to your use of our services.

Service Limitations

Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you to lunarcresters for the services in the twelve (12) months preceding the claim.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government actions.

Indemnification

You agree to defend, indemnify, and hold harmless lunarcresters AS, its officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from or related to your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Denmark.

Dispute Resolution

We encourage resolution of disputes through direct communication. If a dispute cannot be resolved informally, it shall be resolved through the Danish court system. For EU consumers, you may also have the right to use alternative dispute resolution mechanisms.

Termination

Either party may terminate the service relationship at any time with appropriate notice as specified in your service agreement. We reserve the right to terminate or suspend your access to our services immediately if you violate these Terms or engage in prohibited activities.

Effect of Termination

Upon termination, your right to use our services will cease immediately. We will work with you to arrange for the return or disposal of any inventory or materials in our possession, subject to payment of any outstanding fees and costs.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any additional service agreements, constitute the entire agreement between you and lunarcresters AS regarding the use of our services and supersede all prior agreements and understandings.
